I – Binding Agreement

These Terms and Conditions constitute the entire and sole agreement between Innovative Electronic Solutions, LLC (hereinafter Dr. Duino, the Company, or We) and you (the User or the Client) in relation to the use of this website, our products, user manuals, learning materials, and all other services provided by us, including but not limited to, online videos, tutorials, demonstrations, and the like. The present agreement applies to any and all subdomains of drduino.com

Please read this entire agreement very carefully before deciding to do business with us. If you decide to use our website, our products, and/or our services, you agree without reservation to all the terms and conditions stated herein. If you are a minor and you have not reached the legal age of consent, you must refrain from using our website, our products, and/or our services, unless you are under the supervision of your parents or legal guardians.

Please note, these terms and conditions may be revised at any time without prior notice. Any new version of the same will be binding on you. Therefore, we strongly suggest that you visit this page from time to time to keep abreast of the latest version.

Dr. Duino reserves the right to suspend the availability of its products and/or services without prior notice and at its sole discretion. The provision of goods and services prolonged over time is not to be intended as a supply contract and you should not have an expectation that Dr. Duino will be able to fulfill your requests or expectations at a future time. We reserve the right to refuse service to any user, customer, or visitor, and we also reserve the right to limit the quantity of your orders without prior notice.

By placing an order you commit yourself to use our products and services in a lawful manner obeying all applicable international, federal, state, and local laws.

By subscribing to our services you agree not to share your log in credentials with any third parties. You agree not to share your user ID, password, discount coupons or codes, and you also agree to use our products and services for personal use only.

In other words, without our consent, you may not share what you get from us. Failure to do so may result in the immediate termination of your membership/subscription and you may lose the right to request a refund.

Notwithstanding the use of commercial names such as “For Beginners” or “Pioneers”, the services and the products provided by Dr.Duino are intended for the use of people who have knowledge in electrical/electronic engineering, and those who have experience in the field of embedded systems.

Misuse, alteration, and/or modification of our products and its components may cause short circuits, fire, and/or explosions, and result in severe bodily harm, death, and/or property damage. Our kits rely on the end users ability to solder and follow directions. Errors which arise from the end users inability to follow directions are the sole responsibility of the end user.

It is extremely important to understand that a proper use of our products does not entirely exclude the risk of short circuits, fire, and/or explosions. Our user manuals, tutorials, demonstrations, webinars, and all other instructions provided by us are meant to reduce these risks as much as possible, but you should always keep in mind that severe bodily harm, death, and/or property damage may occur. IF YOU DECIDE TO USE OUR PRODUCTS OR SERVICES YOU DO SO AT YOUR OWN RISK. Please, be careful and use common sense.

We strongly advise you to use proper protective equipment when using any of our products including but not limited to eye protection and proper ventilation when soldering.

Our products are not toys and they are not intended to be used by people under the age of 18. Persons under the age of 18, should only use our products and services with a supervising adult. Persons who do not have knowledge in electrical/electronic engineering, should refrain from using our products and services unless properly supervised. Your safety is your own responsibility!

Our products or services are intended for recreational use only. We do not approve the use of our products or services for medical purposes as medical appliances or life-support devices. We will not be responsible for any inappropriate uses of our services or products.

In compliance with the Children Online Privacy Protection Act (COPPA), it is not our intent to collect data from users under the age of 13 and all the users using our services should refrain from doing so as well.

However, at times the information provided may be inaccurate, out of date, or incomplete and thus, we do not guarantee the correctness, the accuracy, and the completeness of any information provided both in our website and in our user manuals. 

By the same token, code, binaries, Standard Tessellation Language (STL) or any other output we provide is also “as is”. Essentially what that means is that we are under no obligation to fix glitches or bugs related to software/firmware errors, and so any code or STL released will be unsupported material for demonstration purposes only.

Should the need arise, you may always unsubscribe and/or request a refund (please read Section V – Returns, Exchanges, and Refunds).


 

IV – Shipping Arrangements  

All items purchased from our company will be shipped pursuant to a shipment contract under Article 2 of the Uniform Commercial Code. As such, our only duty is to get the items to a common carrier and make the proper arrangements for the items to get to you. You bear the risk of loss and the risk of damages, meaning that after we get the goods into the carrier’s possession, we are not responsible for any lost, stolen, or damaged packages.  

Note: depending on the item(s) purchased, you might experience a delayed delivery that can take anywhere from four (4) to eight (8) weeks, the reason being that some of our products are not stored at our local warehouse in the US, and so we need to work with a third-party overseas.  

All demo projects are provided as is and without any warranty or guarantees or operation. You should use them at your own risk. No support is provided.

Also note that you might experience shipping delays depending on your geographic location and usually during holiday seasons due to the volume of orders being processed.

All of our products are shipped using a trackable shipping service, however be mindful that sometimes even though something has been shipped it may not show in the online tracking system.

In the event of lost or damaged packages, all claims filed through us must be communicated no later than 60 days after the original ship date. Due to limitations imposed on us by the carriers, we will not consider any claim untimely filed.

A lost package will be considered lost ONLY AFTER it has not had a trackable movement from the carrier of more than 20 days from the last date of scan for domestic orders within the USA OR 30 days for all international orders.

From time to time we give away free gadgets to members of subscription services. The latter should be aware that at the present time we do not ship said gadgets to outside the contiguous USA or Canada.(Members pay shipping & handling).

 


 

V – Returns, Exchanges, and Refunds

Dr. Duino accepts returns of unused and unmodified products within 30 calendar days from the date of delivery. Said date shall be determined by checking the delivery status for the tracking number associated with the package delivered. To be eligible for a return, the item must not be used, assembled, damaged, and/or with missing parts. All items must be returned in the original packaging. Should you find that you r kit is missing parts or has a damaged PCB, you are encouraged to contact us before assembling the kit.  

To complete your return, you need to provide a proof of purchase.

To return an item, first contact us at customerservice@drduino.com You will be given specific instructions on how to process the return. You will be responsible for the shipping costs.

We only replace items if they are defective or damaged and in any case for causes not attributable to your misuse, alteration or modification of the item. Depending on where you are located, the time for you to get your replaced product could vary considerably. Subject to product availability, Dr. Duino reserves the right to issues a refund instead of replacing the item.

If you ship back an item worth over $50, you should consider using a trackable shipping service or purchasing shipping insurance. Dr. Duino does not guarantee that we will receive your returned item(s).

Upon receiving and inspecting the returned item(s), you will be notified by email of the approval or rejection of your refund. If you are eligible for a refund, a credit will be applied to your method of payment within a reasonable time not exceeding 30 business days.

25% Restocking fee will apply to all returns. Refunds only apply to physical items. Digitally delivered items will not be refunded.

We hope you will be happy with the products and the services we provide, but if you are not, you may unsubscribe from our services, mailing list, promotional e-mails, and the like, at any time and a prorated portion of your bill will be returned to you by the same method in which you paid for said services initially.

With the exception set forth in the Section VII (Association with Amazon.com, Inc.), Dr. Duino is not affiliated or in any way associated with the other companies whose websites are accessible through those external links. Dr. Duino shall not be held liable and will not bear any responsibility with respect to the content of those websites, the accuracy of the information therein contained, the legality of the same content, and any other link that those pages might contain.

Our website allows the users to post, upload, submit and publish text, video text, images, audio, and the like. You are solely responsible for the material you choose to display on our website. Our website is intended to be a public platform that serves an online community where the users are free to publish content. From time to time, we hold meetings either virtual or in person, in which a person may be recorded. We often times use software platforms such as, but not limited to zoom. In the event that the meetings are recorded, please be aware that any material you share: any part of your name and/or video feed which contains video/images/identity(e.g. first/last name) of the participant will be captured and stored permanently.  

By attending these events, you are granting us irrevocable usage of any material recorded to be used in away way we deem fit which includes redistribution onto any medium we desire. Should you prefer to not be recorded, you should not attend any of these events.


 

IX – Access to the Website

Dr. Duino reserves the right to limit or block certain users from accessing the website or certain website resources or content. Access to our website may be temporarily or indefinitely interrupted as a result of maintenance, repair, equipment malfunction, change of domain name, or any other reason that Dr. Duino may deem appropriate, without prior notice and at its sole discretion.

Should an interruption occur, under no circumstance will the Company be liable for your business interruption, lost profits, lost opportunities, and the like. Dr. Duino will not be responsible for any damages arising out of your inability to use our websites, or to place an order for our products or services.    

 

X – Promotions, Discounts, Free Samples   

Dr. Duino reserves the right to promote its services and products by way of free samples and applying discounts to targeted customers or the public at large. Said promotions, discounts, and free sample will take place from time to time according to our marketing strategies and they are not intended to discriminate those who have bought the same services or products at full price. Said promotions are generally available for a limited time and should not generate any expectation regarding the price of services or products that will be sold in the future time.
